1. Title
“REPLENSIS®” and “The Luxury Planter Collection” are trading names of SKG Landscape Design.

2. Order Placement
All orders must be submitted in writing, either by email or fax, and should reference any company purchase order number or job reference as required. Any discrepancies from the original quotation, e.g. changes in colour, style, size or number of units, should be noted separately in writing, and should be checked against the resulting pro forma invoice.

3. Payment
Unless previously agreed in writing at the time of presentation of quotation, all orders must be paid for in full at the time of ordering. This payment will be deemed to constitute the confirmation of order, and refunds will not be given under any circumstance.
In instances where full prepayment has not been taken, a director of the purchasing company must return a signed and dated Order Confirmation Form acknowledging understanding and agreement of payment terms. SKG Landscape Design retain full ownership of goods, and reserve the right to reclaim goods or withhold delivery until payment terms agreed in the Order Confirmation Form have been met.

4. Discounts
Any discounts offered in the original quotation are at the discretion of the management of SKG Landscape Design, and may be withdrawn if acceptance dates or payment terms laid out in the original quotation have not been adhered to.

5. Cancellation
As all products are fabricated and/or painted to order, cancellation of orders will not be accepted under any circumstance once confirmation of order has taken place.
In instances where a purchasing company no longer wishes to take delivery of an order, they may request in writing the issue of a credit note in lieu of delivery of goods. The decision to grant such a request lies solely at the discretion of the management of SKG Landscape Design, and is normally only granted if a ready buyer for the goods exists.

6. Delivery and Lead Time
Delivery charges, if applicable, are clearly stated on all quotations. These charges will cover delivery to one UK business address during normal business hours, Monday to Friday. Saturday deliveries may be arranged on request, but will be subject to the agreement of the shipping company, and may be subject to a surcharge. Due to the use of third party shipping companies, it is impossible to arrange precise delivery dates and times, although efforts will be made where possible to accommodate written requests on this matter.
Due to the use of third party fabricators and shipping companies, lead times given in quotations are for guidance only. If goods are required by a certain deadline, it is imperative that the purchasing company notify SKG Landscape Design in writing prior to the confirmation of order, and not less than 30 days before the delivery deadline.

7. Damaged Goods
Notification of faulty or defective goods must be made in writing within 48 hours of receipt, accompanied by digital photographs of the damaged goods. Replacements will be arranged with immediate effect. All defective units must be re-packed into their original packaging (including ashbags where applicable), for collection and return to SKG Landscape Design. All costs associated with the replacement of faulty goods will be the responsibility of SKG Landscape Design. However, no liability is accepted for the cost of alternative cigarette waste facilities in the intervening period.

8. Warranty
All products will be covered by warranty against corrosion for 2 years after delivery, provided:
They are being used for the purpose for which they were designed, namely the housing of indoor or outdoor plants and/or the disposal of cigarette waste
They have not been placed in sitting water.
They have not been placed within 100m of the sea.
They have not been placed in area where regular gritting/salting takes place.

9. IP
The design and appearance of REPLENSIS® are protected by EU Design Registration, US Patent, Japanese Design Registration, and Australian Design Registration. A UK patent application has been lodged covering the workings of the REPLENSIS® ashtray component.
REPLENSIS® is a Registered Trade Mark in the EU.

10. Re-Sale
Under the terms of the EU Design Registration, REPLENSIS® can only be sold from new by approved distributors. Therefore any re-sales of REPLENSIS® by non-approved commercial organisations will be in breach of these terms, unless it is clearly stated that the goods are second-hand and without warranty, regardless of whether or not the goods have been used.
